Society of Construction Law: Inaugural Construction Law Digest
The Society of Construction Law Malaysia has published its inaugural Law Digest with articles on 'Pay When Paid Clauses", Acts of Prevention, and a recent case commentary on Sediabina Sdn Bhd & anor v Qimonda Malaysia Sdn Bhd (in liquidation) with regards to the ownership of retention monies. The case in question signifies a move away from other commonwealth jurisdictions, wherein the contractor (beneficiary) of the monies was entitled to its release even after the employer had gone into liquidation and the monies were not specifically set aside in a designated account.
