Society of Construction Law: Inaugural Construction Law Digest

The Society of Construction Law Malaysia has published its inaugural Law Digest with articles on 'Pay When Paid Clauses", Acts of Prevention, and a recent case commentary on Sediabina Sdn Bhd & anor v Qimonda Malaysia Sdn Bhd (in liquidation) with regards to the ownership of retention monies. The case in question signifies a move away from other commonwealth jurisdictions, wherein the contractor (beneficiary) of the monies was entitled to its release even after the  employer had gone into liquidation and the monies were not specifically set aside in a designated account. Construction Industry Payment And Adjudication Bill (CIPA)

The CIPA Bill has been presented to Parliament for its first reading. The Bill is expected to be tabled in Parliament in March 2012. The  CIPA will have a tremendous effect on the construction industry in Malaysia and we expect some major shakeups in regards to how employers deal with main contractors and sub contractors when the bill is legislated. The Firm's 1st Chambering Pupil completes his chambering and takes up employment with the Firm

Mr Vishal V Kumar has completed his chambering with Messrs James Monteiro and was called to the Malaysian Bar in Alor Setar, his home town, on 8th December 2011. Vishal has accepted an offer from the Partners to join the Firm as a legal associate with specialisation in alternative dispute resolution.

Ms Tina Ann Francis joined the firm on 1st December 2011 as a legal associate. Tina was admitted to the Malaysian Bar on August 2010 and has been exposed to both conveyancing and banking matters in her previous practice. Tina's focus will be on litigation.

New Competition Legislation for Malaysia

The Competition Act 2010 and the Competition Commission Act 2010 came into force on 1st January 2012.
